Marriage guidance for South African and foreign-national couples

South African and Foreign National Marriages

When a South African citizen marries a foreign national in South Africa, additional documentation and verification may be required before the marriage can be solemnised and registered.

The exact requirements can depend on the foreign national’s citizenship, passport and immigration documentation, the marital status of both parties, the documents available and the procedures followed by the relevant Home Affairs office.

Wed By Jaco & Team assists couples with understanding the process, preparing the applicable marriage documentation and arranging an authorised marriage officer. Because every couple’s circumstances can differ, the official Wed By Jaco marriage-document guidance and individual confirmation from the marriage officer remain essential.

Why Can Additional Requirements Apply?

A marriage involving a South African citizen and a foreign national may require additional identity, immigration and marital-status verification.

These steps help establish the identity and current marital status of both parties and determine whether the available documentation meets the requirements applicable to the marriage. The precise process should not be assumed from another couple’s experience. Requirements can differ according to citizenship, immigration status, previous marriages, available documents and the Home Affairs office involved.

Start With an Individual Assessment

Before finalising your wedding arrangements, send your information to Wed By Jaco & Team so that your circumstances can be reviewed.

Early assessment is important because foreign documents, marital-status evidence, Home Affairs or Immigration verification, or an interview process may apply. Availability and travel must also be confirmed with the appropriate marriage officer. No verification, approval or processing timeframe can be guaranteed.

Passport and Immigration Documentation

The current official guidance identifies a clear copy of the passport page showing the foreign national’s photograph and personal details. It also identifies a Current Visa, Permit or Entry Stamp page, where applicable, and DHA-31 - Affidavit for the Purpose of Marriage by a Person Without South African Identity Document, where required.

This is an overview, not a replacement checklist. These conditional descriptions must be applied to the couple’s actual circumstances. Wed By Jaco & Team does not provide immigration-law advice about whether a particular visa, permit or immigration status qualifies, and a marriage officer cannot override Home Affairs or Immigration requirements.

Marital-Status Evidence

Both prospective spouses must be legally free to marry. The evidence relevant to a particular couple can depend on citizenship, previous marriages, the available documents and what appears on the Home Affairs system.

Letter of No Impediment or No Trace Letter

The official guidance lists a Letter of No Impediment or No Trace Letter, where applicable. It must not be treated as universally required in every case.

Divorce

The official guidance lists a Final Decree of Divorce, if applicable.

Widowhood

The official guidance lists the Death Certificate of the previous spouse, if applicable.

Home Affairs or Immigration Interview and Verification

A Home Affairs or Immigration interview or verification process may be required. Confirm the exact procedure with the marriage officer and the relevant Home Affairs office.

Additional Home Affairs or Immigration verification may be required before the marriage can be solemnised. Both prospective spouses may be required to attend an interview or verification process. This does not mean that every couple must attend an identical process, and no verification result or timeframe can be guaranteed.

If the South African Citizen Was Previously Divorced

If the Home Affairs system still reflects MARRIED after a legal divorce, the person must personally attend Home Affairs and complete the required process, including biometric or fingerprint verification where required. A marriage officer, agent or third party cannot complete this on the person’s behalf.

This requirement is specifically connected to an incorrect Home Affairs marital-status record after divorce. It does not mean that biometrics are required for every South African and foreign-national marriage.

Before the Wedding

Provide all applicable documentation as early as possible before the wedding. Where Home Affairs or Immigration verification is required, it may need to be completed before the marriage can be solemnised.

To begin the assessment, send:

  • Full names and citizenship of both prospective spouses
  • The foreign national’s nationality and a summary of the passport and immigration circumstances
  • Whether either person was previously married, divorced or widowed
  • Proposed wedding date
  • Venue or town
  • Preferred Christian Wedding Ceremony or Non-Religious Wedding Ceremony
  • A brief summary of the documents or verification already obtained

Choose Your Wedding Ceremony

Nationality and Home Affairs requirements do not determine whether the ceremony is Christian or non-religious. Couples may enquire about either option:

Christian Wedding Ceremony

A warm, personal Christian ceremony with appropriate faith elements discussed with the marriage officer.

Non-Religious Wedding Ceremony

A warm, personal and dignified ceremony without religious content, with appropriate personal elements discussed with the marriage officer.

The Marriage Officer’s Role

The marriage officer can review the information supplied, explain the applicable marriage-document process, identify matters requiring confirmation, conduct the agreed ceremony, guide the legal solemnisation and complete the required marriage documentation.

The marriage officer cannot issue or approve visas or permits, provide an immigration decision, override Home Affairs requirements, guarantee a verification result or correct an inaccurate Home Affairs record without the required departmental process.

Marriage Registration

After the marriage has been legally solemnised and the applicable documentation has been completed, the marriage officer submits the relevant marriage documentation through the applicable Home Affairs process.

Home Affairs is responsible for processing and capturing or registering the marriage on its system. Immediate registration and Home Affairs processing times cannot be guaranteed.
