Marriage Registration in South Africa

Legal marriage registration in South Africa involves more than one step. The marriage must first be legally solemnised by an authorised marriage officer, the applicable marriage documentation must be completed and signed, and the relevant documents must then be submitted through the applicable Home Affairs process.

Home Affairs is responsible for processing and capturing or registering the marriage on its system. Wed By Jaco & Team and the marriage officer do not control when Home Affairs completes that administrative process.

Understanding the difference between solemnisation, documentation, submission and Home Affairs capture helps couples know what happens at each stage and what can reasonably be confirmed.

How the Marriage Registration Process Works

1. Requirements Are Confirmed

Before the wedding, the couple must provide the documents applicable to their citizenship, marital status and circumstances. Where additional verification is required before solemnisation, it must be completed through the applicable process.

2. The Marriage Is Legally Solemnised

An authorised marriage officer conducts the required legal process with the couple. Solemnisation is not the same administrative step as Home Affairs later capturing the marriage on its system.

3. The Documentation Is Completed

The applicable marriage documentation is completed and signed in connection with the legal solemnisation.

4. The DHA-27 Marriage Certificate Is Issued

The marriage officer issues the DHA-27 Marriage Certificate, the handwritten marriage certificate issued in connection with the marriage ceremony. It is not the same as a later marriage certificate or certificate copy obtained through Home Affairs.

5. The Documentation Is Submitted

The marriage officer submits the relevant marriage documentation through the applicable Home Affairs process. Submission does not mean that the marriage officer personally captures the marriage on the Home Affairs system.

6. Home Affairs Processes the Marriage

Home Affairs processes the submitted documentation and captures or registers the marriage on its system. These stages do not necessarily happen simultaneously.

Legal Solemnisation and Home Affairs Registration Are Different Stages

Legal solemnisation is conducted by an authorised marriage officer and includes the couple completing the required legal process and documentation. Home Affairs registration or capture is the later administrative processing of the submitted documentation.

The page does not provide a broad legal opinion about the validity of a specific marriage where submission or system capture is delayed or disputed. Those circumstances must be assessed individually.

The Marriage Officer’s Role

The marriage officer confirms the applicable document category, reviews the information provided, conducts the legal solemnisation, guides the declarations, completes the marriage documentation, issues the DHA-27 Marriage Certificate and submits the relevant documentation through the applicable Home Affairs process.

The marriage officer does not capture the marriage on the Home Affairs electronic system, control processing times, guarantee when the marriage will appear, issue a later Home Affairs marriage certificate or override Home Affairs requirements.

Marriage Certificates — Understanding the Difference

DHA-27 Marriage Certificate

The marriage officer issues the DHA-27 Marriage Certificate in connection with the ceremony. It must not be called an unabridged marriage certificate.

Later Home Affairs Certificate

A later marriage certificate or certificate copy obtained through Home Affairs is a separate document. Wed By Jaco & Team cannot guarantee when the marriage will be captured or when a later certificate will become available.

What Happens After the Ceremony?

After the marriage has been legally solemnised and the applicable documentation has been completed, the marriage officer submits the relevant marriage documentation through the applicable Home Affairs process.

Home Affairs then processes the submitted documentation and captures or registers the marriage on its system. These actions may occur at different times. Couples should retain their DHA-27 Marriage Certificate and any information provided by their marriage officer.

Home Affairs Processing Times

No fixed registration timeframe can be promised. Wed By Jaco & Team can confirm what has been handled by the marriage officer but cannot guarantee when Home Affairs will process or capture the marriage.

The marriage officer also cannot guarantee when the marriage will appear on the Home Affairs system or when a later Home Affairs marriage certificate will become available.

If Your Marriage Does Not Yet Appear on the System

Contact the marriage officer or Wed By Jaco & Team and provide both spouses’ names, the wedding date and the information received from Home Affairs. Retain the DHA-27 Marriage Certificate and follow any process required by Home Affairs for the specific query.

The marriage officer can assist with information concerning the ceremony, documentation and submission but cannot independently change the Home Affairs electronic system. This page does not prescribe a tracking, escalation, resubmission or correction process.

If Home Affairs Reflects the Wrong Marital Status

If the Home Affairs system still reflects MARRIED after a legal divorce, the person must personally attend Home Affairs and complete the required process, including biometric or fingerprint verification where required. A marriage officer, agent or third party cannot complete this on the person’s behalf.

This wording is limited to an incorrect Home Affairs marital-status record after divorce. It must not be generalised to every marriage-registration problem.

Previous Marriages, Divorce and Widowhood

Previous-marriage records can affect the documents and verification required before a new marriage is solemnised. The official guidance identifies a Final Decree of Divorce or Death Certificate of the previous spouse where applicable, together with marital-status verification where relevant.

Marriage Registration for Two South African Citizens

For two South African citizens, the official guidance covers South African identity and witness documentation, photographs, previous-marriage information and an antenuptial-contract letter where applicable.

Marital-status verification may also be relevant. If an incorrect Home Affairs record requires personal attendance or biometric or fingerprint verification, that process must be completed by the affected person where required.

What should we do if our marriage is not showing on the system?

Contact the marriage officer or Wed By Jaco & Team with both spouses’ names, the wedding date and the information received from Home Affairs. Retain the DHA-27 Marriage Certificate and follow any process required by Home Affairs for the specific query.

Can the marriage officer change an incorrect Home Affairs record?

No. The marriage officer cannot independently change the Home Affairs electronic system. The affected person must follow the process required by Home Affairs.

Can someone complete biometric verification on my behalf?

No. Where personal attendance and biometric or fingerprint verification are required, the affected person must attend personally. A marriage officer, agent or third party cannot complete this on the person’s behalf.

What if Home Affairs still reflects MARRIED after my divorce?

Do foreign-national marriages have additional requirements?

Do all Home Affairs offices follow the same administrative process?

Home Affairs offices may apply requirements or procedures differently. A procedure followed at one office should not be presented as guaranteed at every other office.
